Area man sentenced for child exploitation

A rural Clay County man found guilty of felony child exploitation and possession of child pornography charges stemming from a 2006 arrest was sentenced in Clay Superior Court late Monday afternoon.

Brian F. Fischer, 31, was arrested March 2006 by Clay County Sheriff's Deputies for being in possession of a cell phone containing multiple nude pictures of at least one juvenile in suggestive poses.

Having been found guilty, Fischer appeared for his sentencing with his defense attorney before Clay Superior Judge Blaine Akers Monday afternoon.

Clay County Prosecutor Lee Reberger said the testimony in court was emotional for everyone involved.

Sentenced to four years incarceration at the Indiana Department of Correction with good time credit if earned, Akers recommended that Fischer serve two years of said sentence with the Clay County Justice Center and, if determined eligible, he shall be entitled to participate in a work release program with the remaining two years being as part of a home detention program with a GPS device (with no good time credit allowable).

Fischer was also ordered to submit to a DNA sample pursuant to law and register as a sex offender upon release.

Fined the sum of $170, Fischer, who is not incarcerated at this time, was ordered to report to the jail at 8 a.m., Saturday, July 14 for execution of the court order.
