Charges were amended for two juveniles arrested earlier this month for possession of stolen property.
Cody A. Airhart, 17, Carbon, and Aaron C. Krout, 17, Brazil, appeared in Clay Circuit Court Monday, both pleading not guilty to the charges they faced.
Airhart was charged by the Clay County Prosecutor's Office in three separate cases with amended charges of two counts of auto theft, criminal mischief, theft, receiving stolen property and residential entry. The potential penalty for the charges is 3-18 years real-time imprisonment and a $60,000 fine.
Krout faces amended charges in two separate cases of three counts of auto theft and receiving stolen property. If convicted of all charges, Krout faces a total of 2-12 years real-time imprisonment and a potential $40,000 fine.
Both Airhart and Krout have bonded out of the Clay County Justice Center to await the start of their respective jury trials.
Airhart's jury trial is scheduled for Oct. 15, 2007 at 1:30 p.m., while Krout is scheduled to face the jury on Oct. 20, 2007, also at 1:30 p.m.
Since the cases and charges began in juvenile court Clay Circuit Court Judge Joseph Trout is scheduled to preside over both cases. However, both Airhart and Krout will be tried as adults, with Clay County Prosecutor Lee Reberger set to present the State of Indiana's case against them.
Defense Attorney James Organ will be representing Airhart, while Krout has opted to hire his own private defense counsel.
