Malcom E. Applegate, 31, of Brazil, remains in St. Vincent Clay Hospital following an accident.
Applegate was struck by a vehicle operated by Dwain L. Archer, 45, of Brazil as he was crossing National Avenue toward Manatee Street.
Archer stated he was going west on U.S. 40 in the left hand lane. As he came to the Manatee Street intersection he was passing vehicles in the left lane slowing or stopped. As Archer came to the last vehicle in the left lane, a pedestrian walked into the path of his vehicle from the left. He said he attempted to stop and swerved to the right, but his vehicle struck the pedestrian.
Witnesses confirmed that Applegate was crossing U. S. 40 and that he walked in front of the Archer vehicle.
Police later questioned Applegate and he stated he remembered going to Kroger's and then starting north toward U.S. 40, but he did not remember anything else until he awoke in the hospital.
The police report indicated that Applegate's view of the Archer vehicle in the right hand lane of westbound U.S. 40 was apparently blocked by vehicles slowed or stopped in the left hand lane. Archer's view was also blocked by the vehicles in the left hand lane of westbound U.S. 40.
