Former police officer scheduled to testify to Grand Jury today

Thursday, December 9, 2004

- Roger Lindsay scheduled to appear, but filed motion to quash subpoena

A Grand Jury investigation continued today in Clay Circuit Court. Indiana State Police Cold Case Det. Alan McElroy said the Grand Jury was called as one phase of an ongoing double murder investigation.

Tonya Pickett, 16, and her stepfather, Ricky Mustard, 32, were found dead at their Brazil home at 110 W. Pinckley St., on Nov. 18. 1988. Each died of a single gunshot wound to the head.

The initial investigation focused primarily on the death of Mustard. However, McElroy said the Cold Case Team has been centering their investigation on Pickett.

The Grand Jury convened Tuesday with Roger Lindsay as the target. Lindsay was a Captain in the Brazil City Police Department during the double homicide investigation in 1988.

Lindsay was subpoenaed to appear before the Grand Jury. His attorney filed a motion to quash the subpoena Wednesday afternoon, which would excuse Lindsay from appearing. The motion was granted by Judge Ernest Yelton.

Lindsay was not seen by reporters in the courthouse this morning.
