Howard H. Junker III, 40, of Brazil, has been charged by the Clay County Prosecutor's Office on three drug charges stemming from an Aug. 31 arrest by the Brazil City Police Department.
According to the Affidavit for Probable Cause filed in Clay Circuit Court yesterday, Sgt. David Archer witnessed Junker involved in activity consistent with drug use involving a beer can pipe.
While driving a pickup truck westbound on Jackson Street, just east of McGuire Street, Junker was attempting to light the top of a beer can while holding it to his face.
Once the vehicle pulled over, Archer was able to smell the odor of burned marijuana and an alcoholic beverage. He also could see that Junker's eyes were red and the pupils were enlarged, which is common with marijuana usage.
A urine chemical test performed at St. Vincent Clay Hospital determined that marijuana was present in Junker's system.
Junker was arrested and booked into the Clay County Jail. He has bonded out.
Junker's charges include: One count of Possession of Marijuana, a Class A Misdemeanor, punishable with up to one year in jail and a $5,000 fine; one count of Possession of Paraphernalia, a Class A Misdemeanor punishable with up to one year in jail and a $5,000 fine; Operating a Vehicle with a Schedule 1 or 2 Substance or its Metabolite, a Class C Misdemeanor punishable with up to 60 days in jail and a $500 fine.
