Former North Clay Middle School physical education teacher Anita Miller is expected to be in Clay Superior Court Jan. 28, 2009.

Miller, whose original jury trial was set for Dec. 15, was charged with public intoxication (a class B misdemeanor, that if convicted, is punishable with up to 180 days imprisonment and a $1,000 fine) and public nudity (a class B misdemeanor, that if convicted, is punishable with up to 60 days imprisonment and a $1,000 fine).

On Jan. 13, 2008, Miller and Melinda Ellis, a former White River Valley Junior/Senior High School science teacher were arrested after an altercation with deputies who responded to an accident report.

Ellis resigned from her position and pled guilty to operating a vehicle while intoxicated and possession of paraphernalia.

The Clay Community School Board officially released Miller from her contract on March 5, 2008. Her petition to the Clay County Civil Court for a judicial review of her dismissal is currently pending.
