According to information provided by the Clay County Sheriff's Department, Benjamin A. Johnson, 34, was taken into custody Wednesday evening after a struggle in which he allegedly choked the victim and broke her cell phone in an attempt to stop her from calling for help. He was preliminarily charged with domestic battery, strangulation and interfering with reporting a crime at the Clay County Justice Center.
During the course of the investigation, officers discovered an undisclosed amount of marijuana and drug paraphernalia inside the home. This resulted in additional charges of possession of marijuana and possession of paraphernalia being added to Johnson's charging information.
Facing a $7,000 cash bond (with 10 percent allowed), jail officials confirmed Johnson remains incarcerated while awaiting formal arraignment in court per the calendar.
