Staunton man arrested on battery charges

A Clay County man was arrested early Saturday morning amid allegations of battery on a female victim Friday.

According to information provided by the Clay County Justice Center, Robby M. Durbin, 30, Staunton, was taken into custody around 2 a.m., Saturday, and booked into the facility on preliminary charges of domestic battery, strangulation and criminal confinement.

Information by the Clay County Sheriff's Department reports that deputies were dispatched Friday evening to an undisclosed Staunton residence to begin an investigation into an altercation involving Durbin and an unidentified pregnant female.

Allegations include that Durbin hit and choked the victim while forcing down on her abdomen, then confined and refused to let her leave while threatening her life and that of an unidentified child.

However, the victim and the child were able to leave the home after Durbin left the residence and report the incident to authorities.

According to Clay County Sheriff Mike Heaton, drugs and alcohol are not considered factors in this altercation.

Durbin, who posted $7,000 cash bond (with 10 percent allowed) Sunday, is currently awaiting formal court proceedings related to the matter.

The case file has been turned over to the Clay County Prosecutor's Office for review and formal charges to be filed in the matter.

Bond is MUCH TOO LOW!!!!! This boy(can't call him a man-REAL MEN DON'T BEAT UP ON PREGNANT WOMEN) is out on the streets, where he can find the victom and hurt her again, maybe this time the cops will be too late. The laws concerning domestic violence need to be updated and made tougher for the aggressor to get out of jail once he or she is arrested. That restraining order is not worth the paper it is written on if he is out and come after the victim again.

I bet his mama is soooo proud.

Yes this is bad, but virginagrace can you control other people? lets attack his mother, that is so lame. I pray the pregnant women and child is going to be fine. And my sympothy for his family to have to face these judgemental people in Brazil, IN. He was very bad, his family did not do this! Lock him up! But dont blame and belittle his family.

WOW!!! Sometimes i get on here and wonder if the kids in town are commenting on here..attacking his mom??? really??? The fact that this looser beat up a pregnant woman and held her and a child captive is crazy to say the least!!! Ive been in the shoes of this girl years ago and the loser I was dealing with couldnt have had a better mom! This jerk is 30 yrs old for gods sake! Not 12! What a freakin nut case and the sad thing is that is is out??? I pray he dont go after this girl while out on bond...Ive been there and these kind of guys dont think like normal people....hope the girl and child are safe! He is not just crazy now, he is crazy and pissed...

Sorry, I have to defend (somewhat) VIRGINIAGRACE's statement "I bet his mama is so proud". I don't believe (and I may be wrong) this was a slam against this guy's mother, but a comment more like "way to make your Mother proud".

I think her comment may have been taken out of context - and I would be the first to say so, if I thought she was dogging the mother!

That said - I'm constantly amazed at how punks like this "whup up" on women. I can't remember who made the comment once, but he said, (in essence) "let him pull that stuff in a real jail with real criminals". Of course, that "real jail" is not to be confused with the jail in Clay County. ; )

Allowing this guy the priviledge of bonding out is a slap in the face to the victim, her condition and the child who witnessed this bullying.

freedom1 probably said it best with only three words "What a punk." Hopefully this punk will be sent back to prison where he belongs. th1953 ..... It's the same one. Known him since we were teenagers and I was hoping he would straighten his life out, but apparently not. It's a shame really, I would hope his brothers would of had a good influence on him.

freedom1, it's been years since I've been around him. Last time I did see him he was actually working and sounded like he was settling down. Really wish he would have gotten his issues worked out, but some people just don't or won't do it. I think in this case he would just rather be in trouble and be stupid than be a good person. Some never learn.

SCARED your stupid. He beat the crap out of his 9 month pregnant girlfriend she told everyone herself. And yes she took him back he could have killed his baby. but guys come on dont hate on him hes really a good guy lol get with it what if that was your baby or pregnant daughter that he beat. I bet you wouldnt be thinking the same way. Just because you love someone doesnt make them a good person.
