Webster to appear before jury on forgery and theft charges

SPENCER -- A jury trial for a former City of Brazil employee is still scheduled to take place Monday, Oct. 1.

According to court documents, former Brazil Clerk-Treasurer Tracy Webster is scheduled to appear in Owen County Circuit Court Monday, Oct. 1, at 9 a.m., with Judge Frank Nardi presiding.

An initial hearing was scheduled for March 5, but according to court documents, it was rescheduled after defense counsel filed a motion for continuance Feb. 27.

The court, according to documents, has scheduled a five-day jury trial.

Webster faces formal charges of class C felony Forgery and three counts of class D felony Theft.

The allegations stem from a five-month investigation between the Indiana State Police Criminal Investigation Division and the Indiana State Board of Accounts.

The probable cause affidavit from the case alleged Webster was involved in a total of $19,550.54 of unauthorized vendor payments, in addition to overpayment of compensation and/or benefits on numerous occasions between May 4, 2007, and Nov. 21, 2008, while employed in the Brazil City Clerk-Treasurer office.

The case was venued to Owen County after Clay County Prosecutor B. Lee Reberger and Webster's defense counsel came to an agreement on terms for a transfer.

In June 2011, Clay County Superior Court Judge J. Blaine Akers recused himself from the case due to the perception of "potential bias, prejudice or the appearance of impropriety in the case," as his and Webster's families are acquainted.
