CCSD - James Dean Foster, 29, Brazil

After an hour-long standoff with law enforcement, a Brazil man is in custody after a violent domestic altercation Thursday evening.

Clay County Sheriff's Office confirms James Dean Foster, 29, Brazil, faces felony charges of Resisting law enforcement, Intimidation, Domestic battery, and Strangulation from the incident that started shortly after 7 p.m.

According to a press release by the CCSD, around 7:15 p.m., Clay County 911 Dispatch received a 911 call regarding a violent domestic altercation between a mother and a son.

As deputies traveled to 4482 West State Road 340, they were told Foster grabbed his mother by the neck and threw her to the ground. Officials also confirmed Foster had Felony Warrants in Clay County for other battery-related cases.

Upon arrival, law enforcement met the victim and a witness, who said Foster was inside the residence alone.

During attempts to contact Foster, he appeared with a knife and initially rushed toward deputies threatening to kill them.

There was a brief struggle in the doorway, but fortunately, officers could pull back without being injured.

Foster barricaded himself in the home, continuing to yell and threaten officers on the scene.

For more than an hour, officers maintained communication with Foster. He did periodically come outside of the home to talk. It was during one of the times officers took the opportunity to deploy a Taser X26. It temporarily incapacitated Foster, allowing for a safe chance to converge on him. After a brief struggle, Foster was taken into custody and transported to the Clay County Justice Center.

Foster was also booked for Failure to appear in Clay Superior Court earlier this month for court proceedings.

Foster remains in custody on a $10,000 cash bond on the new charges and no bond for the Failure to appear charge awaiting formal court proceedings.

Assisting the Clay County Sheriff's Office was the Brazil Police Department and the Indiana State Police.
