Counsel for Mariposa Legal, a program of COMMON Foundation, filed a complaint in Clay Circuit Çourt Wednesday, December 15, 2021.

The 35-page document filed by Attorney Hannah Cartwright alleges the Clay County Commissioners, Clay County Council, and the Clay County Sheriff’s Department violated the Indiana Open Door Law and Indiana Access to Public Records Act. An 8-page timeline was also presented to the court on Mariposa Legal’s behalf.

The main allegations regard to the defendants' actions of:

“Impairing the ability of concerned community members to obtain reliable information,

“Holding a series of improper gatherings” and “special meetings” during November,

Violating ODL by failure to post meeting dates and meeting minutes in a timely manner,

“failing to respond in a timely manner “ to requests for information about the potential Jail Expansion Project under consideration at the Clay County Justice Center.

The Times has reached out to local officials, who were unavailable for comment of press time.
